Alongside the commercial lease, other regimes govern letting for professional or residential use: professional lease (regulated professions), civil lease, residential lease (1989 Act), furnished letting, mixed-use leases. Professional lease

Lease for exclusively professional use for the regulated professions: minimum 6-year term, termination at any time by the tenant on 6 months' notice, regulated conditions.

Residential lease (1989 Act)

Lease governed by the Act of 6 July 1989: 3-year term (6 years for corporate landlords), strict regulation, recoverable charges, capped security deposit.

Furnished letting

Furnished lease: minimum 1-year term (9 months for students), inventory, LMNP/LMP tax status. Specific contractual and reporting features.

Mobility lease

Short-term lease (1 to 10 months, non-renewable) intended for tenants in a transitional situation (training, assignment, transfer).

Mixed-use lease

Lease for mixed residential and professional use, articulation of the applicable regimes, securing of the specific clauses.

Company accommodation

Provision of company accommodation by the business: occupancy agreement, social-security and tax consequences, management of the end of the arrangement.

Frequently asked questions.

The commercial lease covers traders, craftspeople, manufacturers and the activities of the Commercial Code, with a very protective status (right to renewal, eviction indemnity). The professional lease covers the regulated professions, with a more flexible regime (free termination by the tenant, minimum 6-year term).

This depends on the regime. For a residential lease, the list is exhaustive (1987 decree). For a commercial or professional lease, contractual freedom is broader but is framed by the Pinel Act (prohibition on passing on certain charges, such as property tax in some cases).

1 year minimum (9 months for students, without tacit renewal). The furnished lease may be tacitly renewed. Furnished status requires sufficient furniture to allow normal living (a standard list is defined by decree).

The tenant may terminate at any time on 6 months' notice. The landlord may terminate only at the end of the term, on 6 months' notice and on valid grounds. This flexibility is one of the main attractions of the professional lease compared to the commercial lease.
